Help & advice

Should I change my name by Deed Poll?

Yes, if you are choosing a new name: changing your name by Deed Poll gives you the legal document that proves it, and you can use it from the day you sign. Marriage needs no Deed Poll, because your certificate does that job, and no deed can change a title such as Mr or Dr. Ours costs £18.50, hand-drafted and posted the same working day.

Do you need a Deed Poll?

What GOV.UK says each kind of change needs:

A name you have chosen You need a Deed Poll

A Deed Poll is the document for this

This is the job GOV.UK gives a deed poll: legal proof that your name has changed. It can alter any part of the name, whether that means adding one, dropping one, adding or removing a hyphen, or respelling it.

Taking a spouse’s or civil partner’s surname No Deed Poll needed

Your certificate is the evidence

Taking the surname of your husband, wife or civil partner needs no Deed Poll, on GOV.UK’s guidance: a copy of the marriage or civil partnership certificate goes to each organisation instead. For a passport that covers a double-barrelled name too, and you can apply up to 3 months before the ceremony. Your driving licence after marriage.

Going back to a name after divorce Sometimes

Your certificates may be enough

Showing your marriage certificate together with the final order (once called the decree absolute) may be enough to return to your earlier name, GOV.UK says. Be ready for a few to say no, though: GOV.UK adds that some will only restore the old name on sight of a deed poll. Your driving licence after divorce.

For a passport, HM Passport Office also wants your birth certificate, a statement you sign saying you now use the earlier surname “for all purposes”, and proof you are using it, such as a payslip or a council letter.

A small change to spelling, order or a middle name Sometimes

Not for your passport

To change the spelling slightly, change the order of your forenames or remove a middle name, GOV.UK says a passport needs 2 documents showing you use the new name, such as a bank statement or a letter from your council. Other organisations set their own rules, and some may want a Deed Poll.

Only a title No Deed Poll needed

A deed poll cannot change a title

GOV.UK says you cannot use a deed poll to change titles such as Mr, Mrs or Doctor. DVLA changes a title on the same form as a name, without evidence unless it is a hereditary title, and a passport shows a professional title on its observations page, with evidence.

Name and gender A Deed Poll, for your records

A Deed Poll or a statutory declaration

DVLA accepts a deed poll, a statutory declaration or a Gender Recognition Certificate when your name and gender change. A new birth certificate comes only with a Gender Recognition Certificate.

A child’s name A Child Deed Poll

Applied for by a parent

For a child under 16, a parent applies for a Child Deed Poll, and every person with parental responsibility must consent. Without that consent, the route is a court order. From 16, they can apply for an Adult Deed Poll themselves.

A lost Deed Poll A Replacement Deed Poll

Your name has not changed back

A lost Deed Poll is drafted again as a Replacement, recording the change you already made and the date you made it.

The document

What a Deed Poll does, and what it does not

It does

  • Prove the change. That you gave up one name and adopted another
  • Work straight away. GOV.UK says you can use a signed one at once
  • Cover any part of your name. First names, surname, hyphens, spelling or order

It does not

  • Change a record by itself. Each organisation updates its own, when you show it
  • Rewrite your birth certificate. In England and Wales the two are shown together
  • Go on a register. Unless you choose to enrol it
  • Change a title, such as Mr, Mrs or Doctor
Your own, or ours

Make it yourself, or have it drafted

Both are allowed, and both prove the change. The difference is who checks it, what it is printed on, and what happens if an organisation turns it down.

Questions & answers

More about choosing a Deed Poll

Is a Deed Poll legally binding?

Yes. On GOV.UK’s own definition it is a legal document proving a change of name, and once signed it works as proof of your new name at once.

Can I write my own Deed Poll?

Yes, from 16. GOV.UK supplies wording and asks for 2 witnesses aged 18 or over. It also warns that a home-made deed may be refused by some organisations, so check with the ones you deal with before relying on one.

How many witnesses should sign yours?

Two. Ours has a space for each, and we recommend using both: adults over 18, not related to you and not living with you. It is the same number GOV.UK’s own wording names. Who can witness it.

Do I need a Deed Poll if I got married?

Not to take your spouse's or civil partner's surname: GOV.UK says your certificate is the evidence, and for a passport that includes a double-barrelled name. You need a Deed Poll only when the new name goes beyond what the certificate shows.

What does it cost?

Our Adult, Child and Replacement Deed Polls are £18.50 each. Certified copies, delivery and a board-backed envelope are optional extras, chosen at the checkout. Every cost of a name change.

What if an organisation refuses it?

Ask what it objects to, in writing, and ask for a second look. If a Deed Poll we have drafted is ever refused, we refund you in full.

Something else? Ask a paralegal and we will answer, usually the same working day.

Ready to make it official?

Apply online in about five minutes. Your Deed Poll is drafted, checked and dispatched the same working day, and guaranteed to be accepted.
