Driving licence after divorce

Change the name on your driving licence after divorce

Your divorce papers can be enough. To go back to an earlier surname, post form D1 to DVLA with your licence, your decree absolute or final order, and your birth or adoption certificate, or send a Deed Poll instead. It is free and by post only, and GOV.UK says the new licence usually comes within 3 weeks.

  • Free at DVLA
  • Divorce or dissolution

Three ways to prove it to DVLA

DVLA takes your divorce or dissolution papers with your birth certificate, a Deed Poll, or the number of a passport that already shows the name you have gone back to. Any one of them will do, and the change itself costs nothing.

Your envelopes

What to post to DVLA after a divorce

Choose your licence, your proof and whether you keep a vehicle, and the envelopes show only what you need. Without script, every item is listed with who it is for.

  • Send originals. Photocopies, laminated certificates and copies certified by someone else, even at a Post Office, are turned away.
  • One proof is enough. GOV.UK asks for at least one of them, so choose the route that suits you. How to choose.
  • Back separately. DVLA returns your documents by second class post, apart from the licence. Add a stamped, self-addressed Special Delivery or Signed For envelope to track them.

Papers or a Deed Poll

Divorce papers or a Deed Poll?

Both change your licence. GOV.UK’s own advice for going back to an earlier name warns that some organisations will not change it without a deed poll, so think past DVLA before you choose.

Why some people use a Deed Poll anyway

  • The name is not your birth name. Going back to a surname from an earlier marriage? Your birth certificate cannot show it, so the papers DVLA lists do not join up.
  • An organisation insists. GOV.UK itself warns that a few organisations refuse to restore an earlier name unless they see a deed poll.
  • More than the surname is changing. Dropping a middle name or changing a first name goes beyond what divorce papers show, so DVLA needs a Deed Poll for it.
  • It says only what it needs to. A Deed Poll gives the name you are giving up and the one you are taking, so it can go everywhere without your divorce papers.
Online?

Can I change it back online?

No. When your name or title has changed, GOV.UK’s renewal guidance allows only a postal application, and a Post Office counter cannot take one for a new name. Updating your address online does not help: GOV.UK sends anyone changing their name at the same time to the postal form.

The car and motorbike form is the D1, and the lorry and bus form is the D2, which goes to DVLA, Swansea, SA99 1BR. A lost or stolen licence still goes on the same form, with £20 by cheque or postal order: a lost licence and a new name.

Scotland and Northern Ireland

England, Scotland and Wales

DVLA, wherever you divorced

DVLA holds the licence records for all of Great Britain, so the route is the same in Scotland: form D1 to Swansea. Its list names the English and Welsh papers, though, and a Scottish divorce is proved by a divorce certificate, or extract, from the Scottish courts. If you are unsure DVLA will take yours, a Deed Poll settles it.

The DVA, on form DL1

Licences here come from the Driver & Vehicle Agency. Complete section 1d of form DL1, from main Post Office branches, and post it with your licence: nidirect says a new name cannot be reported online, and there is no fee.

nidirect accepts the same proof as GOV.UK: your divorce or dissolution papers with your birth or adoption certificate or UK naturalisation certificate, a deed poll, or a statutory declaration, all as originals. The DVA aims to finish in 10 working days; allow six weeks before chasing.

After the licence

Your passport, your log book and your children

Your passport

To go back to an earlier surname, HM Passport Office asks for your birth certificate, a signed statement that you now use that name “for all purposes”, a document showing you use it, and a marriage certificate with both names on. Do it first and DVLA takes the new passport number. GOV.UK’s rules, and which to do first.

Your log book

The V5C changes separately, and GOV.UK asks for no proof after a divorce: your name in section 3, the whole log book and a letter saying why. Not telling DVLA can mean a fine of up to £1,000. The log book, in full.

Your children’s surname

A child’s surname does not change with yours. For a child under 16, a parent applies for a Child Deed Poll, and everyone with parental responsibility has to agree. The Child Deed Poll, £18.50.

Everyone else who has your married name, from your bank to your employer: who to tell, and in what order.

Questions & answers

More about your licence after divorce

Do I need a Deed Poll to change my driving licence back after divorce?

Not necessarily. DVLA accepts your divorce or dissolution papers together with your birth or adoption certificate, or your UK naturalisation certificate. A Deed Poll is the other route, and it is the one to use when the name you want is not your birth name or when more than your surname is changing. Papers or a Deed Poll.

What documents does DVLA need after a divorce?

Form D1, your current licence and one proof of the change, as originals: the decree absolute or final order (or decree nisi or conditional order) with your birth or adoption certificate or UK naturalisation certificate; or a Deed Poll with one document in your restored name; or, if your UK passport already shows the name, its number on the form. What to post, step by step.

Can I change the name on my driving licence online after divorce?

No. GOV.UK only takes a postal application once your name has changed, and a Post Office counter cannot take one either. Pick up the D1 pack at a Post Office that offers DVLA services and post it to DVLA, Swansea, SA99 1BN.

Does it cost anything to go back to my maiden name on my licence?

No. DVLA makes no charge for the name. You pay £17 only for a new photo at the same time, or £20 if your licence has been lost or stolen, by cheque or postal order made out to DVLA. If you have lost your divorce papers, a copy from England or Wales costs £14.

Can I use my decree nisi or conditional order?

Yes. GOV.UK’s list of documents for a driving licence names the decree nisi and the conditional order alongside the decree absolute and the final order, each sent with your birth or adoption certificate or UK naturalisation certificate.

I am going back to a name from an earlier marriage. What do I send?

Your birth certificate cannot show a surname from an earlier marriage, so the papers on DVLA’s list do not connect. Use a Deed Poll, posted with one document in that name dated in the last 12 months, or a UK passport number if your passport already shows it.

How long does it take after a divorce?

GOV.UK says a licence applied for by post usually comes within 3 weeks, longer if DVLA checks your identity or medical details. Your papers or Deed Poll come back separately, by second class post. A new log book can take up to 6 weeks.

How do I change my licence after divorce in Northern Ireland?

On form DL1 from a main Post Office branch, with section 1d filled in, posted to the DVA at County Hall, Coleraine, BT51 3TB. nidirect accepts your divorce or dissolution papers with your birth or adoption certificate, a deed poll or a statutory declaration, as originals. It is free, and it cannot be done online. Northern Ireland in full.

Will DVLA send my divorce papers back?

Yes. DVLA posts your documents back by second class post, separately from your new licence. To follow their progress, include a stamped, self-addressed Special Delivery or Signed For envelope with your application.
